Terms of Use

1. Eligibility & Accounts

You must be at least 18 years old and capable of entering into a binding contract to use the Services.

To access certain features, you may be required to create an account via our authentication provider. You agree to:

• Provide accurate and complete registration information
• Maintain the security of your login credentials
• Promptly update any information necessary to keep your account current
• Accept responsibility for all activity under your account

2. Subscription Plans & Billing

We may offer different plans, including Free, Pro, and Elite tiers. Plan features, pricing, and limits are described in the product interface or on our website and may change from time to time.

If you purchase a paid subscription, you authorize us and our payment processor to charge your selected payment method for recurring fees until you cancel. Unless otherwise stated:

• Subscriptions renew automatically at the end of each term
• You may cancel at any time, but fees already paid are generally non-refundable
• We may change prices with reasonable notice, and such changes will apply on your next billing cycle

3. Use of the Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business purposes.

You agree not to, and will not assist or permit others to:

• Use the Services for any unlawful purpose
• Reverse engineer, decompile, or attempt to extract source code
• Circumvent plan limits, rate limits, or security controls
• Use automated scripts, bots, or scrapers to access the Services in a way that could harm performance or stability
• Misrepresent yourself or falsify information related to your account or activity

3.1 AI Assistant & Automated Outputs

WheelBert™ includes AI-powered features that can generate text, summaries, explanations, analytics, or suggestions based on your inputs, prompts, and account data. You understand and agree that:

• AI outputs may be inaccurate, incomplete, or outdated
• AI may "hallucinate" or generate incorrect or nonsensical information
• AI responses are automated, not reviewed by humans
• You are solely responsible for verifying the accuracy of any output
• You will not rely on AI responses as the sole basis for any financial decision

You acknowledge that AI-generated content is provided as-is and may not reflect real-time market conditions, correct calculations, or complete analysis.

4. No Investment Advice; AI Limitations

WheelBert™ and LetsWheelIt™ provide tools, analytics, automated AI responses, and educational content for informational purposes only. Nothing in the Services constitutes investment, financial, tax, legal, or trading advice.

Specifically:

• AI-generated content (including answers, explanations, alerts, trade ideas, roll suggestions, probabilities, or analytics) is not investment advice
• AI outputs may be incorrect, misleading, or inconsistent
• Market data, options chains, pricing, greeks, or probabilities may be delayed, inaccurate, or estimated
• You must independently verify all trading decisions and consult qualified professionals as needed

Your use of WheelBert™ does not create an advisory, brokerage, or fiduciary relationship.

5. Data, Content & Intellectual Property

The Services, including all software, design, text, graphics, and other materials, are owned by WheelBert™ by LetsWheelIt™ or our licensors and are protected by intellectual property laws.

You retain any rights you have to your own inputs and content you submit to the Services. By using the Services, you grant us a non-exclusive license to process your inputs and display results solely for providing the Services, improving them, and supporting you.

5.1 AI Inputs and Outputs

By using the AI features of WheelBert™, you grant us the right to process your prompts, inputs, account information, and contextual data for the purpose of generating AI responses and improving the Services. You agree that:

• Your inputs may be sent to third-party AI model providers
• We do not claim ownership over your prompts or outputs
• AI outputs may contain errors
• You will not submit sensitive personal information (e.g., SSN, financial account numbers, private keys) to the AI
• You remain fully responsible for any content you submit or generate using WheelBert™

6. Third-Party Services

The Services may depend on or integrate with third-party services such as data providers, brokers, authentication, or payment processors. We do not control these third-party services and are not responsible for their content, policies, or availability.

Your use of third-party services is subject to their separate terms and privacy policies.

7. Disclaimers

The Services are provided on an "AS IS" and "AS AVAILABLE" basis, without warranties of any kind, whether express or implied. To the maximum extent permitted by law, we disclaim all warranties, including:

• Merchantability
• Fitness for a particular purpose
• Non-infringement
• Accuracy, timeliness, or completeness of data or results

We do not warrant that the Services will be uninterrupted, secure, error-free, or that any defects will be corrected. Market data, options chains, and calculations may be delayed, incomplete, or inaccurate, and you should not rely on them as your sole source of information.

AI-Specific Disclaimers

The AI functionality in WheelBert™ relies on machine learning models that may produce unexpected, incorrect, or inappropriate outputs. We make no guarantees regarding:

• Accuracy of probabilities, greeks, calculations, or forecasts
• Suitability of automated suggestions or explanations
• Data freshness or real-time accuracy
• Interpretation of your prompts
• Correctness of AI-generated summaries or trade logic

You acknowledge that you use all AI-generated content at your own risk.

8. Limitation of Liability

To the maximum extent permitted by law, WheelBert™ and its owners, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill, arising out of or in connection with your use of the Services.

Our total liability for any claim relating to the Services will not exceed the greater of (a) the amount you paid for the Services in the 3 months preceding the event giving rise to the claim, or (b) 100 USD.

9. Termination

You may stop using the Services at any time. We may suspend or terminate your access to the Services, or any part of them, if we believe:

• You have violated these Terms
• Your use poses a risk to the Services or other users
• We are required to do so by law

Upon termination, your right to use the Services will cease immediately. Certain sections of these Terms, including ownership, disclaimers, and limitations of liability, will survive termination.

10. Changes to the Services and Terms

We may update, modify, or discontinue parts of the Services at any time. We may also update these Terms from time to time. When we do, we will revise the "Last updated" date at the top of this page.

If you continue to use the Services after changes to the Terms take effect, you agree to the updated Terms.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Texas, USA, without regard to its conflict of laws principles. Any disputes arising out of or relating to these Terms or the Services will be brought exclusively in the courts located in Texas, and you consent to their jurisdiction.
